Onder 2.7 Gerechtshof Amsterdam 7 april 2015

Een door Servaas in het geding gebracht voorbeeld van een Exploration and Production Sharing Agreement gesloten tussen de KRG en WesternZagrosLimited luidt, voor zover van belang, als volgt: "15.5 Waiver of Sovereign Immunity Any party that now or hereafter has a right to claim sovereign immunity for itself or any of its assets hereby waives such immunity to the fullest extent permitted by the laws of any applicable jurisdiction. This waiver includes immunity from (i) any expert determination or arbitration proceeding commenced pursuant to this Agreement; (ii) any judicial, administrative or other proceedings to aid the expert determination or arbitration commenced pursuant to this Agreement, and (iii) any effort to confirm, enforce, or execute any decision, settlement, award, judgment, service of process, execution order or attachment (including pre-judgment attachment) that results from an expert determination, arbitration or any judicial of administrative proceedings commenced pursuant to this Agreement. Each party acknowledges that its rights and obligations hereunder are of a commercial and not a governmental nature. (...) 21.5 Enurement and Third Party Rights This Agreement shall be binding upon and enure to the benefit of the parties and their respective successors and permitted assigns. Unless specially provided in this Agreement (...), the parties do not intend that any term of this Agreement be enforceable by any person who is not a party to this Agreement."
