De onder 2.5 vermelde overeenstemming op hoofdlijnen is nader uitgewerkt in een door [appellant] ondertekende Letter of Offer van 6 november 2009. In deze Letter of Offer is onder punt 7 onder meer vermeld: “Immediately upon execution of this Letter of Offer, the Vendors [ [M] c.s.] and the Company shall continue to deliver to (…) [ [X] ]” en onder punt 9 is onder meer vermeld: “Upon execution of this Letter of Offer by all of the parties thereto, the Financier [ [X] ] shall deposit Euros Two Hundred and Forty Thousand (“the Deposit”) into an interest-bearing call deposit with a licensed bank or financial institution in Kenya (…) in the joint names of the Vendors’ and the Purchaser’s Advocate.”
