In HR 27 januari 1989, NJ 1989, 506, is overwogen dat de vóór de inwerkingtreding van de Rijkswet van 12 januari 1977, Stb. 160, in de Nederlandse rechtspraak ontwikkelde opvatting - kort gezegd: het komt aan (niet op de letterlijke bewoordingen van het octrooischrift maar) op datgene waarin naar het wezen van de zaak de geoctrooieerde uitvinding bestaat - ook na die inwerkingtreding nog tot uitgangspunt kan worden genomen, zulks evenwel met inachtneming van het in art. 30 lid 2 ROW vervatte voorschrift, inhoudende dat het uitsluitend recht "wordt bepaald door de inhoud van de conclusies van het octrooischrift, waarbij de beschrijving en de tekeningen dienen tot uitleg van de conclusies". Zoals in dat arrest vervolgens is overwogen, is de strekking van het voorschrift, het midden te houden tussen twee in het protocol bij art. 69 EOV bedoelde uitersten en aldus "a fair protection for the patentee" te combineren met "a reasonable certainty for third parties". Die twee uitersten worden in de eerste twee zinnen van het protocol als volgt omschreven: "Article 69 should not be interpreted in the sense that the extent of the protection conferred by a European patent is to be understood as that defined by the strict, literal meaning of the wording used in the claims, the description and drawings being employed only for the purpose of resolving an ambiguity found in the claims. Neither should it be interpreted in the sense that the claims serve only as a guideline and that the actual protection conferred may extend to what, from a consideration of the description and drawings by a person skilled in the art, the patentee has contemplated."
