Volgens de notulen van buitengewone aandeelhoudersvergaderingen is aangaande de kwijtscheldingen het volgende besproken: “Under discussion was the proposal to grant [belanghebbende] an undue compensation for its activities carried out in the year 1988” - respectievelijk 1989, 1990, 1991 en 1992 - “such as activities for opening new markets, development of new products etc. (…) It was decided to grant this compensation by means of an acquittal of credits on account current to the amount of the compensation.”.
