Gevraagd naar de invloed van art. 1 van de Cadmiumrichtlijn op de Speelgoedrichtlijn heeft de Expert Group on toy safety van de Europese Commissie in een Guidance Document, genoemd in de conclusie van de Advocaat-Generaal onder 16, verwezen naar deze bepaling uit de Speelgoedrichtlijn en opgemerkt dat "toys, in addition of fulfilling the daily limit of 0,6 micrograms for the bioavailability of cadmium set by the Directive 88/378/EEC, have to comply with the additional restrictions imposed by Directive 91/338/EEC" (de Cadmiumrichtlijn)
