An accused is confronted at the beginning of police interrogation with a fundamental dilemma: remain silent or break silence? Under such conditions article 6 requires that the accused have the assistance of a lawyer. The situation in wich the accused finds himself is one where the rights of the defence may well be irretrievably prejudiced.
