(iii) De ontslagbrief vermeldt als “actions” die “both individually and jointly” voor Hyatt grond voor het ontslag op staande voet zijn: “(…) you pushed a female colleague after which she fell and you kicked her while she was lying on the floor. According to the statement of one of your colleagues, he had to intervene to make you stop kicking the female colleague while she was on the floor. Several employees witnessed that the nose of the female employee colleague was bleeding”, en voegt hieraan toe “(...) we established that you were the one attacking the female employee by pushing her and kicking her while she was on the floor, which aggressive behavior is unacceptable”.
