11. Tijdens de Quantum-fase, voorafgaand aan PFA4, kwam BAe (het werd issue 55) terug op de limitation period (…) en wees op laatstvermelde artikelen van de UNIDRO1T Principes. Zij betoogde dat het scheidsgerecht: “ has made no finding as to whether the claimant‘s claims are time barred by reason of a limitation period which is non-extinctive. Accordingly, the tribunal had not yet fully complied its mandate (...) It must now consider (...) whether the UNIDROIT Principles provide for a fixed limitation period which, whilst not extinctive of the right, nevertheless gives the defendant a defence within the provisions of the Terms of Reference. ” (…).
