21. To secure enforcement in Jersey, BNP Jersey would present the First Act of Court to the Royal Court's enforcement officer (the Viscount). As I note above in paragraph [12], the Act of Court gives effect to the judgment. Therefore when enforcing the Act of Court the Viscount is enforcing the judgment. He simply does not require to be given a copy of it in order to initiate enforcement. If the Viscount were satisfied that there were sums payable under the Act of Court and that there were assets available in Jersey, then on provision of an indemnity for her own costs she would take the necessary steps to seize the assets and transfer them or their sale proceeds to BNP Jersey, up to the relevant amount. In case of doubt as to the sum due, the court may be asked to confirm the position. In this instance the Fourth Certificate represents such confirmation, given by the Master of the Royal Court. However in general terms certificates of the kind produced in this case for overseas courts would not be needed for enforcement to take place in Jersey.
