Alinea 98 Parket bij de Hoge Raad 24 oktober 2003
Een alinea uit Parket bij de Hoge Raad 24 oktober 2003, ECLI:NL:PHR:2003:AF7557.
6. Most States taxing capital gains do so when an alienation of capital assets takes place. Some of them, however, tax only so-called realized capital gains. Under certain circumstances, though there is an alienation no realized capital gain is recognized for tax purposes (e.g. when the alienation proceeds are used for acquiring new assets). Whether or not there is a realization has to be determined according to the applicable domestic tax law. No particular problems arise when the State which has the right to tax does not exercise it at the time the alienation takes place.
