Alinea 102 Parket bij de Hoge Raad 31 oktober 2003

Een alinea uit Parket bij de Hoge Raad 31 oktober 2003, ECLI:NL:PHR:2003:AI0346.

'Whether or not any particular means is an essential element of a given invention will be a question of fact in each case. It will clearly cover the supply of a product in kit form to be assembled by the purchaser into an infringing item, but where the dividing is to be drawn between essential and inessential elements is not clear. [...] In general, it is suggested that better guidance would be obtained by considering the element in question and determining whether without that element the invention could be put into effect. A component may be essential to working of the infringing device, but of no relevance to the question whether that device falls within the claim, and in such a case it would seem not to be an essential element as contemplated in the subsection.'(26)
