Alinea 87 Parket bij de Hoge Raad 31 oktober 2003

Een alinea uit Parket bij de Hoge Raad 31 oktober 2003, ECLI:NL:PHR:2003:AI0346.

'When deciding between these approaches it is necessary to bear in mind the concept underlying Art. 26, namely that the supply of means for utilizing the invention is regarded as prohibited use of the invention. In order to ensure that the benefit derived by the supplier can be fairly attributed to the invention, Art. 26 requires not only that the means be supplied and intended for utilizing the invention, but also that they must be of a certain nature which confirms that it is the invention which has created the market for them. On this ground it is submitted that only where the means are part of the invention's concept as defined by the claims, or at least substantially related to this concept, can it be said that their existence or the demand for them flows from the patent. The "concept of the invention" includes those elements of the claims upon which the invention is founded. On the other hand, where the means are merely functionally necessary for practising the invention, or are intended for use with it, and bear no particular relation to its teachings, their supply is too remote to be regarded as use of the invention. Such means may be technically necessary for making or using the patented product or carrying out the patented process, but they are not essential to the foundation of the invention.'(...).
