Alinea 209 Parket bij de Hoge Raad 27 januari 2006

Een alinea uit Parket bij de Hoge Raad 27 januari 2006, ECLI:NL:PHR:2006:AR6513.

-63. The Court recalls at the outset that in proceedings originating in an individual application it has to confine itself, as far as possible, to an examination of the concrete case before it (...). Accordingly, what is at stake in the present case is not the fairness of the proceedings as such which were instituted against the applicant. Rather, the Court is called upon to examine whether or not the imposition of a fine on the applicant for having failed to provide certain information complied with the requirements under the Convention. It follows from this that the Court is not deciding in the present case the issue whether a State can oblige a taxpayer to give information for the sole purpose of securing a correct tax assessment.
