" B has offered to write a software programme for A's production. During the negotiations B incurs considerable expenses in supplying A with drafts, calculations and other written documentation. Shortly before the conclusion of the contract is expected to take place, A invites C, who can make use of the information supplied by B, to make a bid for the programme, and C makes a lower bid than the one made by B. A then breaks off the negotiations with B and concludes a contract with C. A is liable to B for his expenses in preparing the documentation."(18)
