Een alinea uit Parket bij de Hoge Raad 30 september 2013, ECLI:NL:PHR:2013:859.
However, whilst the essentially declaratory nature of the Court's judgments leaves it up to the State to choose the means by which to erase the consequences of the violation (see Marckx, cited above, § 58, and Verein gegen Tierfabriken Schweiz (VgT) v. Switzerland (no. 2) [GC], no. 32772/02, § 61, ECHR 2009), it should at the same time be pointed out that the adoption of general measures requires the State concerned to prevent, with diligence, further violations similar to those found in the Court's judgments (see, for example, Salah v. the Netherlands, no. 8196/02, § 77, ECHR 2006-IX (extracts). This imposes an obligation on the domestic courts to ensure, in conformity with their constitutional order and having regard to the principle of legal certainty, the full effect of the Convention standards, as interpreted by the Court.
