Onder 4.18 Parket bij de Hoge Raad 30 september 2013

Een alinea uit Parket bij de Hoge Raad 30 september 2013, ECLI:NL:PHR:2013:863.

"What does the principle actually mean? People are not identical - that is what makes them attractive and interesting - and their personal circumstances are equally seldom, if ever, identical. Thus, equality can apply only to certain facets of equality. But which? The principle of equality says nothing about this. It requires only that, in the case of a given equality, equality of treatment must follow. Thus, any statement of the principle is very close to being tautological; i.e., one could say, as plain as the nose on your face. (...) It is, in a semantic sense, an empty concept."(72)
