"38. As to the proportionality, the Court notes that the applicants were not able to continue the business legally without the environmental permit and that the service station had to be closed down. They still own the premises but it is difficult to see how any other activity could be started there as the real estate has been designated in the local town plan to be used as a service station only. The applicants have apparently not been awarded any compensation so far but it is possible for them to file such a claim against the State.
