52. The Court cannot overlook the legislative process leading to the enactment of the law affecting the applicant. It observes that the Constitutional Court found, in its first decision (see paragraph 11 above), the measure unconstitutional for being confiscatory, especially in regard to statutorily provided severance to civil servants who could not be considered to have received it in violation of good morals or otherwise illegally.
