In a 1990 Geman Bundesfinanzhof ruling, a German independent Sales representative claimed to be his own agent in the former East German Republic (DDR). The court, however, stated that an agency relationship requires that the agent acts instead of his principal within the framework of the latter company, thus implying two different persons. The legal agency relationship departs from indeed two different persons, namely the principal and the agent. If the principal acts as an agent, he in fact represents himself, which makes an agency relationship redundant. (…)
