158. The Court first notes that there existed no clear and specific legal basis for placing children lacking an adequate command of the Croatian language in separate classes. (…) The Government have not shown that this practice has been applied in respect of any other pupils lacking an adequate command of the Croatian languaglanguage in any other part of Croatia, and not only in respect of Roma children in several schools in MeĊimurje County, including the two schools in question. Consequently, the impugned measures can hardly be seen as part of a common and general practice designed to address the problems of children who lack an adequate command of the Croatian language.
