Onder 7.4 Parket bij de Hoge Raad 14 maart 2017

Een alinea uit Parket bij de Hoge Raad 14 maart 2017, ECLI:NL:PHR:2017:221.

Benefits in kind are valued at the actual value they represent for the beneficiary (article 36 of the ITC), i.e. the amount the beneficiary would have to pay to acquire the same benefit in normal circumstances (Comm. ITC 36/9). The price paid by the employer in order to provide the benefit is of minor importance in this regard. For instance, if the employee receives a mobile phone, which he or she can use for private purposes, the employee receives a taxable benefit in kind. The value of this benefit is determined on the basis of its actual value for the employee; in practice, this is based on the invoice issued by the operator.
