Een alinea uit Parket bij de Hoge Raad 14 maart 2017, ECLI:NL:PHR:2017:221.

Benefits in kind are defined as the passing of a benefit, either free of charge or at a price below the actual value. Benefits in kind are treated as taxable income and must be added to the taxpayer’s salary (article 82 of the CGI). The benefits must be taken at their full value if granted free of charge. If granted at a price below the actual value (i.e. part of the value of the benefit is deducted from the salary), the part which exceeds the amount charged must be added to the taxable income.
