Het EHRM stelde een schending van art. 6 lid 1 EVRM vast. Het EHRM herhaalde “that an opinion of a medical expert, as it falls outside the probable area of expertise of judges, is likely to have a preponderant influence on the assessment of the facts and to be considered as an essential piece of evidence” (…). “In this connection, the Court reiterates that a lack of neutrality on the part of an appointed expert may in certain circumstances give rise to a breach of the principle of equality of arms” (rov. 47 - 48). Toegepast op het geval van Korošec, stelde het EHRM vast dat de opdrachten aan deze commissies van artsen niet waren gegeven door de rechter: de commissies rapporteerden aan het bestuursorgaan dat hen had ingesteld. De uitgebrachte rapporten werden door het bestuursorgaan behandeld als expert opinions. Om praktische redenen was de rapportage ook door de nationale rechters opgevat als expert medical evidence . Daarom maakte het EHRM een vergelijking met zijn jurisprudentie over eisen die gesteld moeten worden aan onderzoek door deskundigen die door de rechter zelf zijn benoemd (rov. 51). Het Hof besprak daarbij drie factoren uit het arrest Eggertsdóttir/IJsland: ( 1) the nature of the task entrusted to the experts; (2) the expert’s position within the hierarchy of the opposing party; and (3) their role in the proceedings, in particular the weight attached by the court to their opinions .
