11. Art. 10 EVRM waarborgt het fundamentele recht op vrijheid van meningsuiting, welk recht “constitutes one of the essential foundations of a democratic society.” Hoewel het EHRM (hierna ook Hof te noemen) zich niet in algemene termen uitlaat over de vraag welke gedragingen onder het bereik van art. 10 EVRM vallen, kan uit de Straatsburgse rechtspraak wel worden afgeleid dat het Hof zowel een objectieve als een subjectieve toets aanlegt: “in deciding whether a certain act or conduct falls within the ambit of Article 10 of the Convention, an assessment must be made of the nature of the act or conduct in question, in particular of its expressive character seen from an objective point of view, as well as of the purpose or the intention of the person performing the act or carrying out the conduct in question.” Art. 10 EVRM biedt aldus bescherming aan uiteenlopende gedragingen, zoals het uitdelen van flyers en het omhooghouden van spandoeken, een protestactie in een universiteitsgebouw of het met verf besmeuren van een standbeeld.
