Een alinea uit Parket bij de Hoge Raad 24 september 2021, ECLI:NL:PHR:2021:847.

Deze klacht ketst af op het in rov. 3.3.8 geciteerde gedeelte uit par. 5 (“ Conclusion ”) van Nortel 1. Daarin staat: “The two acceptable configurations would provide a 2 symbol DPCCH to rely on to perform the measurement to support the power operation (…). It might well be that a TFCI is needed to indicate the speech rate and the presence of signalling, making the configuration 2 TFCI bits + 2 TPC bits + 0 pilot [optie 3 dus, A-G] the only viable option for the support of EVRC. There would be no pilot bit and the SIR estimation would rely on the 2 bits TPC + 2 bits TFCI. ” [onderstrepingen toegevoegd, A-G] Een DPCCH is een neergaand besturingskanaal (zie rov. 1.2.m en hiervoor 1.16). Het citaat noemt als viable option een configuratie van 2 TFCI bits en 2 TPC bits zonder piloot bits. Daaruit mocht het hof opmaken dat de vakman na lezing van Nortel 1 zou begrijpen dat pilootbits niet nodig zijn voor een neergaand besturingskanaal.
