In this case the first question for discussion is whether the UN enjoys immunity. The District Court answered this question affirmatively in its interim judgment of July 10th 2008 and declared it was not competent to take cognizance of the claim against the UN. This judgment was confirmed right up to the court of last resort in The Netherlands. Claimants then submitted a complaint to the European Court of Human Rights (hereinafter referred to as: ECHR) that on June 11th 2013 declared their complaint to be without merit.
