Onder 4.35. Rechtbank Den Haag 16 juli 2014
Een alinea uit Rechtbank Den Haag 16 juli 2014, ECLI:NL:RBDHA:2014:8748.
Other than Claimants argue the way in which the UN enjoys immunity is not relevant. International law of custom offers no support for Claimants’ position that given immunity the “broadest possible” measures of attribution for Dutchbat’s actions must be applied, as otherwise Dutchbat would be placed “above the law”. The opinion of the Supreme Court in the judgment referred to under 1.1 that according to current international law the absence of an alternative judicial process is not prejudicial to the immunity of the UN (confirmed by the ECHR see: 4.3) underlines the fact that the UN’s immunity is not patient of the formulation of an argument that Dutchbat’s actions beyond the framework of current international law are attributable to the State.
