In order to attribute ultra vires actions to the State supplying the troops there is no requirement for said state to give any instruction or order relating to ultra vires action or that this specifically influences the case in some other way. What is decisive is that the State delivering the troops retains the powers it has after transfer of command and control to the UN as well as the relevant say in respect of and with it effective control over self-willed powers acting beyond the powers the UN has granted or against the instructions of the UN concerning the actions of troops put at the UN’s disposal. In this regard the District Court points to the explanation of the ILO at Clause 7 DARIO in which inter alia the following is recorded:
