In Article 2 paragraph 1 ECHR and Article 6 paragraph 1 ICCPR the right to life is established as a fundamental human right in Article 3 ECHR and Article 7 ICCPR incorporates the prohibition of torture and inhuman treatment. From these treaty obligations there arises a positive obligation on the State to protect the right to life and the physical integrity of the person subject to the legal system of the states that are Contracting States.
