After having considered the totality of the Parties’ submissions and having deliberated, the Tribunal concludes that Article 26 of the ECT is not inconsistent with the Constitution, laws or regulations of the Russian Federation. The terms of the Russian Federation’s Law on Foreign Investment (both the 1991 and 1999 versions) are crystal clear. Investor-State disputes such as the present one are arbitrable under Russian law.
