In a reaction to the above mentioned the Public Prosecutor stated that she withdrew her appeal against the decision of the examining magistrate because there was to be no relevance in a preliminary enquiry by the time that a decision on the appeal (or in cassation) would be given. The Public Prosecutor denied further that she brought forward a hidden legal remedy against the decision of the examining magistrate by requesting the Court to decide on the jurisdiction in this stage of the proceedings.
