Op 9 mei 2008 vraagt [K] van Fortis Legal in een e-mail aan [CFO] (CFO en lid van de ERCC) in het kader van de beantwoording van de due diligence questionnaire voor de uitgifte van de NITSH II: ’In particular please comment on the progress of the EC remedies enforcement.’ Fortis geeft hierop als antwoord: ‘In respect of the announced sale of certain Dutch activities under the agreed EC remedies, we are making good headway.’ [K] antwoordt: ‘… If progress goes as planned, we should give details. If, on the other hand, there is already a reasonable likelihood at this stage that implementation of EU remedies could be delayed or proceed at a significant cost, this too often repeated ‘blank’ statement could seriously backfire in a few month’ time. At such time, we will have a hard case claiming that we did not know already something today. This could expose Fortis and the persons participating in the call of allegations of deliberately misrepresenting the facts (exposing all concerned to civil and criminal sanctions, not at least in the US).’ (OK-rapport 517-519)
